A maximum prison sentence of five years now hangs over two former senior FBI officials following federal charges that they misled Congress about the bureau's handling of the Hunter Biden laptop investigation.

The Department of Justice announced the indictment on Friday. It targets Nikki Floris, who formerly led the intelligence division of the FBI's Washington field office, and Bradley Benavides, a former deputy assistant director for counterintelligence. US Attorney Jeanine Pirro's office is prosecuting the case. Both defendants appeared before a federal magistrate judge on Friday morning and were subsequently released.

Prosecutors allege that the pair intentionally withheld information during their 2023 testimonies before the House Judiciary Committee. An FBI affidavit states that Floris denied any involvement in the Hunter Biden probes while testifying. The document claims she was actually in frequent communication with the case team for more than a year. It further alleges she claimed ignorance of the laptop when she had coordinated the FBI's real-time response to news coverage of the device.

Benavides testified several months after Floris. He told the committee that he knew little about the matter and learned of the laptop's existence via a Wikipedia entry while preparing his remarks. The affidavit contradicts this, stating he maintained constant communication regarding the laptop over a period of days. One committee member said these answers shaped the investigation by hindering follow-up interviews and subpoenas.

In a statement, US Attorney Pirro said the pair undermined the institutions they swore to uphold. She argued that lying to Congress strikes at the core of the democratic system. Pirro stated that when senior agents believe they are above the law, it is time to apply the full force of justice against them.

Defense attorneys for Floris rejected the allegations, arguing the Justice Department acted on political claims rather than facts. They described Floris as a patriot who served the FBI for nearly 20 years. They noted the timing of the charges, filing them years after the testimony on the eve of an election. Ron Safer, attorney for Benavides, asked the court to review whether prosecutors possessed sufficient evidence against the two public servants.

US Magistrate Judge Zia M. Faruqui questioned the timing of the charges and their material impact on the investigation. He granted a defense request for a hearing to weigh the government's evidence, setting the date for Tuesday. Faruqui noted that such a rapid hearing is rare for defendants who have been released. He observed that the charges were filed more than three years after the original testimony.

Faruqui described the defendants as having sparkling backgrounds in law enforcement and an interest in clearing their names quickly. He used the phrase Sword of Damocles to describe the burden of the charges, noting the matter would follow them for the rest of their lives.

The laptop at the center of the case has been a political focal point since 2019, when a computer shop owner handed it to the FBI. The owner stated that Hunter Biden dropped off the device and never returned to collect it. Democrats have described the laptop as part of a Republican conspiracy, while Republicans assert it holds evidence of corruption in the Biden family.

The case arrives as many FBI agents accused by President Donald Trump allies of working against him have left the bureau since the start of his second term. Some of these agents say they were dismissed for investigating Trump, while others cite a lack of loyalty to the president as the reason for their departure.
